{"id":9296,"date":"2021-10-18T17:39:24","date_gmt":"2021-10-18T17:39:24","guid":{"rendered":"https:\/\/nlnnpc-mashinaki.savviihq.com\/amendments-to-the-insured-risks-class-1\/"},"modified":"2025-06-29T17:30:42","modified_gmt":"2025-06-29T17:30:42","slug":"amendments-to-the-insured-risks-class-1","status":"publish","type":"post","link":"https:\/\/nnpc-marine.com\/de\/amendments-to-the-insured-risks-class-1\/","title":{"rendered":"Amendments to the Insured Risks, Class 1"},"content":{"rendered":"<section class=\"l-section wpb_row height_small\"><div class=\"l-section-h i-cf\"><div class=\"g-cols vc_row via_flex valign_top type_default stacking_default\"><div class=\"vc_col-sm-12 wpb_column vc_column_container\"><div class=\"vc_column-inner\"><div class=\"wpb_wrapper\"><div class=\"wpb_text_column\"><div class=\"wpb_wrapper\"><p>The board has, pursuant to changes to the International Group Agreement and the reinsurance program, decided that in accordance with Article 14.2 of the Regulations the following amendments will be made to the Insured Risks, Class 1:<\/p>\n<h2>Amendment Rule 28: Fines<\/h2>\n<\/div><\/div><\/div><\/div><\/div><\/div><\/div><\/section><section class=\"l-section wpb_row height_small\"><div class=\"l-section-h i-cf\"><div class=\"g-cols vc_row via_flex valign_top type_default stacking_default\"><div class=\"vc_col-sm-6 wpb_column vc_column_container\"><div class=\"vc_column-inner\"><div class=\"wpb_wrapper\"><div class=\"wpb_text_column\"><div class=\"wpb_wrapper\"><h3>Existing Rule<\/h3>\n<p><strong>Class 1, Rule 28: Fines<\/strong><\/p>\n<ul>\n<li class=\"list__item\">A.\u00a0 \u00a0Fines imposed on the member or upon any other person or party whom the member is legally liable to indemnify for:\n<ul>\n<li class=\"list__item\">1.\u00a0 \u00a0Short or over-delivery of cargo;<\/li>\n<li class=\"list__item\">2.\u00a0 \u00a0Breach of any customs or immigration law or regulation;<\/li>\n<li class=\"list__item\">3.\u00a0 \u00a0An accidental escape or discharge of any substance, provided that the pollution and the event giving rise thereto are covered pursuant to the Rules of the Association.<\/li>\n<li class=\"list__item\">4.\u00a0 \u00a0Any other fine to the extent that:\n<ul>\n<li class=\"list__item\">a.\u00a0 \u00a0the Board of Directors is satisfied that the member took reasonable steps to avoid the events giving rise to the fine; and<\/li>\n<li class=\"list__item\">b.\u00a0 \u00a0the Board of Directors decides that the member may recover, for which no reasons need be given.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<li class=\"list__item\">B.\u00a0 \u00a0Subject to the discretion of the Board pursuant to Rule 28 A.4, there shall be no recovery under this Rule in respect of fines or penalties arising out of:\n<ul>\n<li class=\"list__item\">1.\u00a0 \u00a0Overloading of the insured vessel;<\/li>\n<li class=\"list__item\">2.\u00a0 \u00a0Illegal fishing;<\/li>\n<li class=\"list__item\">3.\u00a0 \u00a0Personal act or default on the part of the member;<\/li>\n<li class=\"list__item\">4.\u00a0 \u00a0Wilful misconduct on the part of any person unless the member is compelled by law to pay the fine.<\/li>\n<li class=\"list__item\">5.\u00a0 \u00a0An infringement of MARPOL regulations, including but not limited to cases where the insured vessel\u2019s oily water separator or similar pollution prevention device has been bypassed or rendered inoperable;<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/div><\/div><\/div><\/div><\/div><div class=\"vc_col-sm-6 wpb_column vc_column_container\"><div class=\"vc_column-inner\"><div class=\"wpb_wrapper\"><div class=\"wpb_text_column\"><div class=\"wpb_wrapper\"><h3>Amended Rule<\/h3>\n<p><strong>Class 1, Rule 28: Fines\u00a0<\/strong><\/p>\n<ul>\n<li>A. Fines imposed on the member or upon any other person or party whom the member is legally liable to indemnify for:\n<ul>\n<li>1. Short or over-delivery of cargo;<\/li>\n<li>2. Breach of any customs or immigration law or regulation;<\/li>\n<li>3. An accidental escape or discharge of any substance, provided that the pollution and the event giving rise thereto are covered pursuant to the Rules of the Association.<\/li>\n<li>4. Any other fine to the extent that:\n<ul>\n<li>a. the Board of Directors is satisfied that the member took reasonable steps to avoid the events giving rise to the fine; and<\/li>\n<li>b. the Board of Directors decides that the member may recover, for which no reasons need be given.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<li>B. Fines or penalties arising from the smuggling of goods or cargo or any attempt thereat.<\/strong><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/div><\/div><\/div><\/div><\/div><\/div><\/div><\/section><section class=\"l-section wpb_row height_small\"><div class=\"l-section-h i-cf\"><div class=\"g-cols vc_row via_flex valign_top type_default stacking_default\"><div class=\"vc_col-sm-12 wpb_column vc_column_container\"><div class=\"vc_column-inner\"><div class=\"wpb_wrapper\"><div class=\"wpb_text_column\"><div class=\"wpb_wrapper\"><h2>Amendment to Rule 54: Obligations of the member in respect of excluded risks<\/h2>\n<\/div><\/div><\/div><\/div><\/div><\/div><\/div><\/section><section class=\"l-section wpb_row height_small\"><div class=\"l-section-h i-cf\"><div class=\"g-cols vc_row via_flex valign_top type_default stacking_default\"><div class=\"vc_col-sm-6 wpb_column vc_column_container\"><div class=\"vc_column-inner\"><div class=\"wpb_wrapper\"><div class=\"wpb_text_column\"><div class=\"wpb_wrapper\"><h3>Huidig Reglement<\/h3>\n<p>Class 1, Rule 54: Obligations of the member in respect of excluded risks<\/p>\n<ul>\n<li class=\"list__item\">54.1\u00a0 \u00a0Where, notwithstanding the exclusions in Rules 33, 34 and\/or 35, liabilities, costs and expenses of a Member are discharged by the Association pursuant to a demand made under:\n<ul>\n<li class=\"list__item\">1.\u00a0 \u00a0guarantee or other undertaking given by the Association to the Federal Maritime Commission under Section 2 of US Public Law 89-777; or<\/li>\n<li class=\"list__item\">2.\u00a0 \u00a0a certificate issued by the Association in compliance with Article VII of the International Conventions on Civil Liability for Oil Pollution Damage 1969 and 1992 or any amendments thereof; or<\/li>\n<li class=\"list__item\">3.\u00a0 \u00a0an undertaking given by the Association to the International Oil Pollution Compensation Fund 1992 in connection with STOPIA; or<\/li>\n<li class=\"list__item\">4.\u00a0 \u00a0a certificate issued by the Association in compliance with Article 7 of the International Convention on Civil Liability for Bunker Oil Pollution Damage 2001; or<\/li>\n<li class=\"list__item\">5.\u00a0 \u00a0a certificate issued by the Association in compliance with Article 4bis of the Athens Convention Relating to the Carriage of Passengers and Their Luggage by Sea 2002; or<\/li>\n<li class=\"list__item\">6.\u00a0 \u00a0a certificate issued by the Association in compliance with Article 12 of the Nairobi International Convention on the Removal of Wrecks 2007; or<\/li>\n<li class=\"list__item\">7.\u00a0 \u00a0any other guarantee, certificate or undertaking issued or given by the Association pursuant to any statute, convention, treaty or law,<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>the member shall indemnify the Association to the extent that any payment under any such guarantee, undertaking or certificate in discharge of the said liabilities, costs and expenses is or would have been recoverable in whole or in part under a standard P&amp;I war risks policy had the member complied with the terms and conditions thereof, whether or not the member as actually taken out P&amp;I war risks cover.<\/p>\n<\/div><\/div><\/div><\/div><\/div><div class=\"vc_col-sm-6 wpb_column vc_column_container\"><div class=\"vc_column-inner\"><div class=\"wpb_wrapper\"><div class=\"wpb_text_column\"><div class=\"wpb_wrapper\"><h3>Amended Rule<\/h3>\n<p><strong>Class 1, Rule 54: Obligations of the member in respect of excluded risks <\/strong><\/p>\n<ul>\n<li class=\"list__item\">54.1\u00a0 \u00a0Where, notwithstanding the exclusions in Rules 33, 34 and\/or 35, liabilities, costs and expenses of a Member are discharged by the Association pursuant to a demand made under:\n<ul>\n<li class=\"list__item\">1.\u00a0 \u00a0guarantee or other undertaking given by the Association to the Federal Maritime Commission under Section 2 of US Public Law 89-777;
